Compliant Language Guide

Edited

Truemed is excited to offer HSA/FSA payment and reimbursement options for your products and services, and we look forward to seeing the success it brings to your business. As we hope you promote this option broadly and frequently, we have provided guidance on compliant marketing practices below.

If you would like Truemed to review any marketing materials, please reach out to us at merchants@truemed.com.

TLDR:

  • Not all products are eligible for HSA/FSA spending, e.g. workout classes are eligible, t-shirts with your brand’s logo are not.

  • Your eligible products and services are eligible because:

    • (1) They have been shown to be effective in treating, mitigating, or preventing certain conditions. Not because they are health and wellness products.

    • (2) A licensed clinician has determined that a specific consumer has the condition, or is the type of person who would benefit from the given product and services.

  • Therefore, consumers do not automatically qualify to use HSA/FSA for your eligible products and services. They qualify by having a Letter of Medical Necessity (LMN) linking your specific product or service to a specific intervention for a specific consumer. Truemed makes the process of obtaining a LMN easy and seamless.

  • When marketing, don't imply that everyone can pay with HSA/FSA. Only qualified or eligible consumers can.

  • Don’t frame spending of HSA/FSA funds as a discount. Frame it as savings.

  • The amount of savings varies by customer based on their specific tax situation. We recommend suggesting the savings is “30% on average

  • Your eligible products and services have always been eligible for qualified consumers with a Letter of Medical Necessity. Truemed makes it convenient for your consumers to receive their Letter of Medical Necessity, and therefore become qualified.

Consumer + Product Eligibility

A Letter of Medical Necessity (LMN) is not issued automatically; it requires a practitioner’s review of the survey and subsequent approval. Don't imply that all of your consumers can pay with HSA/FSA. Only qualified or eligible consumers can.

Also, not all products and services are eligible for reimbursement (e.g. workout classes are eligible, t-shirts with your brand’s logo are not.)

Eligible products and services are eligible because they have been shown to be effective in treating, mitigating, or preventing certain conditions. Not because they are health and wellness products.

When talking about HSA/FSA eligibility, avoid implying default eligibility for products or people, and avoid using terms like "wellness."

Saving with HSA/FSA

Using HSA/FSA funds isn't a direct discount. The savings come from the fact that these funds are pre-tax, allowing consumers to save an amount equivalent to their usual tax rate. Since tax rates depend on various factors, the savings from using HSA/FSA funds can vary from person to person, typically ranging between 25-40%.

Use the word savings not discount. Use average when qualifying the savings, not a specific amount. Make sure to specify which consumers can access this payment option: eligible and qualified ones.
